CHIEF INSPECTOR DELANEY SAYS AUTHORITY IS GRANTED BY ACT OF 1876
CAN ENACT ORDINANCES
J. C. Delaney, Chief Factory Inspector of Pennsylvania, attended the inquest this morning after having inspected the Opera House. He says that all requirements of the law seem to have been complied with at the Opera House.
Members of the town council and the burgess have claimed that the borough has not the power to enact the ordinance regulating theaters, but according to Chief Delaney this is incorrect. Mr. Delaney said this morning:
The act of legislature of 1876 gives the necessary authority to town councils to enact such ordinances that will provide for the safety of the people. The borough has absolute control, and can pass ordinances to cover the conditions here without interfering with state laws.
“We have tried to have the legislature pass such laws as would cover the case of moving picture shows, and while the senate stood for us, the house did not, and the measure failed of enactment.”
Mr. Delaney says he is here to take care of his department and to see that no unjust blame is attached to it.
